Description (English)
New buildings owned by public bodies must be built as zero-emission buildings. A zero-emission building causes no on-site carbon dioxide emissions from fossil fuels, has a very high energy performance and must, where economically and technically feasible, be able to react to external signals and adapt its energy use, generation or storage. Its energy demand must not exceed the nationally set maximum threshold, which is at least 10 % below the threshold applicable to nearly zero-energy buildings on 28 May 2024; operational greenhouse gas emissions are also subject to a nationally set maximum threshold. The total annual primary energy use must be covered by renewable energy generated on site or nearby, by a renewable energy community, by an efficient district heating and cooling system or by carbon-free sources; where that is not technically or economically feasible, other grid energy meeting nationally set criteria is sufficient. The obligation applies from 1 January 2028 to new buildings owned by public bodies. From 1 January 2030 it applies to all new buildings; that second stage is recorded as a separate obligation. Until then every new building must be at least a nearly zero-energy building and meet the nationally set minimum energy performance requirements. Member States may exempt buildings for which a building permit application was already made before those dates. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner.

Neue Gebäude im Eigentum öffentlicher Einrichtungen sind als Nullemissionsgebäude zu errichten. Ein Nullemissionsgebäude verursacht an seinem Standort keine CO₂-Emissionen aus fossilen Brennstoffen, hat eine sehr hohe Gesamtenergieeffizienz und muss, soweit wirtschaftlich und technisch realisierbar, auf externe Signale reagieren und seinen Energieverbrauch, seine Energieerzeugung oder -speicherung anpassen können. Der Energiebedarf darf den national festgelegten Höchstwert nicht überschreiten, der mindestens 10 % unter dem am 28. Mai 2024 geltenden Schwellenwert für Niedrigstenergiegebäude liegt; auch die betriebsbedingten Treibhausgasemissionen unterliegen einem national festgelegten Höchstwert. Der gesamte jährliche Primärenergieverbrauch ist aus erneuerbaren Quellen am Standort oder in dessen Nähe, aus einer Erneuerbare-Energie-Gemeinschaft, aus einem effizienten Fernwärme- und -kältesystem oder aus kohlenstofffreien Quellen zu decken; ist das technisch oder wirtschaftlich nicht möglich, genügt andere Netzenergie nach national festgelegten Kriterien. Die Pflicht gilt ab dem 1. Januar 2028 für neue Gebäude, die sich im Eigentum öffentlicher Einrichtungen befinden. Ab dem 1. Januar 2030 gilt sie für alle neuen Gebäude; diese zweite Stufe ist als eigene Pflicht erfasst. Bis dahin muss jedes neue Gebäude mindestens ein Niedrigstenergiegebäude sein und die national festgelegten Mindestanforderungen an die Gesamtenergieeffizienz erfüllen. Die Mitgliedstaaten können Gebäude ausnehmen, für die vor diesen Zeitpunkten bereits ein Baugenehmigungsantrag oder ein entsprechender Antrag gestellt wurde. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
