Non-residential buildings must be equipped with a building automation and control system in so far as this is technically and economically feasible. The system must continuously monitor, log, analyse and allow adjustment of energy use, establish benchmarks for the building’s energy efficiency, detect losses of efficiency of technical building systems and inform the person responsible about possible improvements, enable communication between connected technical building systems and other applications inside the building including across proprietary technologies, and monitor indoor environmental quality by 29 May 2026. The obligation had to be met by 31 December 2024 in non-residential buildings with an effective rated output for heating systems, air conditioning systems, combined space heating and ventilation systems or combined air conditioning and ventilation systems above 290 kW. By 31 December 2029 it applies to non-residential buildings above 70 kW; that second stage is recorded as a separate obligation. Buildings whose system performs the required functions are exempt from the regular inspection of heating, ventilation and air-conditioning systems. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner.

Nichtwohngebäude sind mit einem System für die Gebäudeautomatisierung und -steuerung auszustatten, soweit das technisch und wirtschaftlich realisierbar ist. Das System muss den Energieverbrauch kontinuierlich überwachen, protokollieren, analysieren und dessen Anpassung ermöglichen, Benchmarks zur Energieeffizienz des Gebäudes aufstellen, Effizienzverluste gebäudetechnischer Systeme erkennen und die zuständige Person über mögliche Verbesserungen informieren, die Kommunikation zwischen verbundenen gebäudetechnischen Systemen und anderen Anwendungen im Gebäude auch bei unterschiedlichen herstellereigenen Technologien ermöglichen und bis zum 29. Mai 2026 die Raumklimaqualität überwachen. Die Pflicht war bis zum 31. Dezember 2024 in Nichtwohngebäuden mit einer effektiven Nennleistung für Heizanlagen, Klimaanlagen, kombinierte Raumheizungs- und Lüftungsanlagen oder kombinierte Klima- und Lüftungsanlagen von über 290 kW zu erfüllen. Bis zum 31. Dezember 2029 gilt sie für Nichtwohngebäude mit mehr als 70 kW; diese zweite Stufe ist als eigene Pflicht erfasst. Gebäude, deren System die geforderten Funktionen erfüllt, sind von der regelmäßigen Inspektion der Heizungs-, Lüftungs- und Klimaanlagen befreit. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
