Description (English)
Member States must lay down rules on penalties for infringements of the national provisions adopted under this Directive and take all measures necessary to ensure that they are applied. The penalties must be effective, proportionate and dissuasive. The Directive does not set their nature or level; these follow only from national transposition law. For the minimum energy performance standards for non-residential buildings, Article 9(7) expressly requires appropriate monitoring mechanisms and penalties under Article 34 and directs Member States to take account of the financial situation of building owners and their access to financial support. The penalty provision backs every obligation of this Directive, so no single rule set is attached to it.

Die Mitgliedstaaten erlassen Vorschriften über Sanktionen für Verstöße gegen die nach dieser Richtlinie erlassenen nationalen Vorschriften und treffen alle für ihre Anwendung erforderlichen Maßnahmen. Die Sanktionen müssen wirksam, verhältnismäßig und abschreckend sein. Art und Höhe legt die Richtlinie nicht fest; sie ergeben sich erst aus dem nationalen Umsetzungsrecht. Für die Mindestvorgaben an Nichtwohngebäude verlangt Artikel 9 Absatz 7 ausdrücklich geeignete Überwachungsmechanismen und Sanktionen nach Artikel 34 und weist die Mitgliedstaaten an, dabei die finanzielle Lage und den Zugang zu finanzieller Unterstützung der Hauseigentümer zu berücksichtigen. Die Sanktionsnorm bewehrt sämtliche Pflichten dieser Richtlinie; ihr ist deshalb kein einzelnes Regelwerk zugeordnet.
