Description (English)
The Act obliges developers and building owners to fit parking spaces in and adjacent to buildings with ducting infrastructure and to install recharging points for electromobility. The duties differ according to residential and non-residential buildings, to new construction, major renovation and existing stock, and to the number of parking spaces. Non-residential buildings owned by small and medium-sized enterprises and predominantly used by them themselves are outside the scope. Infringements of the fitting-out duties are administrative offences punishable by a fine of up to EUR 10,000. Article 7 of the Act of 23 July 2026 (Federal Law Gazette 2026 I No. 226) aligned the Act with Directive (EU) 2024/1275; that version applies from 1 January 2027, lowers the parking space thresholds, introduces pre-cabling and tightens the requirements for existing non-residential buildings.

Das Gesetz verpflichtet Bauherren und Gebäudeeigentümer, Stellplätze in und an Gebäuden mit Leitungsinfrastruktur auszustatten und Ladepunkte für die Elektromobilität zu errichten. Die Pflichten unterscheiden nach Wohn- und Nichtwohngebäuden, nach Neubau, größerer Renovierung und Bestand und nach der Zahl der Stellplätze. Nichtwohngebäude, die kleinen und mittleren Unternehmen gehören und überwiegend von diesen selbst genutzt werden, sind vom Anwendungsbereich ausgenommen. Verstöße gegen die Ausstattungspflichten sind Ordnungswidrigkeiten und können mit einer Geldbuße bis zu 10.000 Euro geahndet werden. Durch Artikel 7 des Gesetzes vom 23.07.2026 (BGBl. 2026 I Nr. 226) wurde das Gesetz an die Richtlinie (EU) 2024/1275 angepasst; diese Fassung gilt ab dem 01.01.2027 und senkt die Stellplatzschwellen, führt die Vorverkabelung ein und verschärft die Anforderungen an bestehende Nichtwohngebäude.
