Description
The Act obliges developers and building owners to fit parking spaces in and adjacent to buildings with ducting infrastructure and to install recharging points for electromobility. The duties differ according to residential and non-residential buildings, to new construction, major renovation and existing stock, and to the number of parking spaces. Non-residential buildings owned by small and medium-sized enterprises and predominantly used by them themselves are outside the scope. Infringements of the fitting-out duties are administrative offences punishable by a fine of up to EUR 10,000. Article 7 of the Act of 23 July 2026 (Federal Law Gazette 2026 I No. 226) aligned the Act with Directive (EU) 2024/1275; that version applies from 1 January 2027, lowers the parking space thresholds, introduces pre-cabling and tightens the requirements for existing non-residential buildings.

This Act serves to transpose Article 8(2) to (6) of Directive (EU) 2018/844 of the European Parliament and of the Council of 30 May 2018 amending Directive 2010/31/EU on the energy performance of buildings and Directive 2012/27/EU on energy efficiency (OJ L 156, 19.6.2018, p. 75). Official note of the legislator on EC law: transposition of Directive 2018/844 (CELEX no. 32018L0844). According to its own footnote, the Act of 23 July 2026 (Federal Law Gazette 2026 I No. 226), Article 7 of which amends this Act, serves to transpose Directive (EU) 2024/1275 of the European Parliament and of the Council of 24 April 2024 on the energy performance of buildings (OJ L, 2024/1275, 8.5.2024).

(1) Dieses Gesetz regelt die Errichtung von und die Ausstattung mit der vorbereitenden Leitungsinfrastruktur und der Ladeinfrastruktur für die Elektromobilität in zu errichtenden und bestehenden Gebäuden.

(1) This Act governs the construction of, and the fitting-out with, the preparatory ducting infrastructure and the recharging infrastructure for electromobility in buildings to be constructed and in existing buildings.

(1) Dieses Gesetz regelt die Errichtung von und die Ausstattung mit der vorbereitenden Leitungsinfrastruktur und der Ladeinfrastruktur für die Elektromobilität in zu errichtenden und bestehenden Gebäuden.

§ 1 Absatz 2 § 1 Absatz 2 § 1 Absatz 2

(2) Dieses Gesetz ist nicht anzuwenden auf Nichtwohngebäude, die sich im Eigentum von kleinen und mittleren Unternehmen befinden und überwiegend von diesen selbst genutzt werden.

(2) This Act does not apply to non-residential buildings which are owned by small and medium-sized enterprises and are predominantly used by them themselves.

(2) Dieses Gesetz ist nicht anzuwenden auf Nichtwohngebäude, die sich im Eigentum von kleinen und mittleren Unternehmen befinden und überwiegend von diesen selbst genutzt werden.

§ 2 — Begriffsbestimmungen § 2 — Definitions § 2 — Begriffsbestimmungen

Im Sinne dieses Gesetzes ist oder sind 1.
„Eigentümer“ der Eigentümer des Gebäudes, bei einer Aufteilung nach dem Wohnungseigentumsgesetz auch die Gemeinschaft der Wohnungseigentümer,
2.
„elektrische Infrastruktur“ der Teil der technischen Ausrüstung, der für den Betrieb aller elektrisch oder elektromotorisch betriebenen Anlagen des Gebäudes oder des Parkplatzes notwendig ist, einschließlich der elektrischen Leitungen, der technischen Komponenten und der damit zusammenhängenden Ausstattung,
3.
„Elektromobil“ ein elektrisch betriebenes Fahrzeug nach § 2 Nummer 1 in Verbindung mit § 1 Satz 1 Nummer 1 des Elektromobilitätsgesetzes vom 5. Juni 2015 (BGBl. I S. 898), das zuletzt durch Artikel 2 Absatz 34 des Gesetzes vom 20. Dezember 2022 (BGBl. I S. 2752) geändert worden ist, in der jeweils geltenden Fassung,
4.
„Gebäudenutzfläche“ die Nutzfläche eines Wohngebäudes nach DIN/TS 18599-1: 2025-10, die beheizt oder gekühlt wird,
5.
„größere Renovierung“ die Renovierung eines Gebäudes, bei der mehr als 25 Prozent der Oberfläche der Gebäudehülle einer Renovierung unterzogen werden,
5a.
„intelligentes Laden“ ein Ladevorgang, bei dem die Intensität des an die Batterie gelieferten Stroms auf der Grundlage elektronisch übermittelter Informationen dynamisch angepasst wird,
5b.
„isoliertes Kleinstnetz“ ein Netz mit einem Verbrauch von weniger als 500 Gigawattstunden im Jahr 2022, das nicht mit anderen Netzen verbunden ist,
6.
„kleine und mittlere Unternehmen“ Unternehmen im Sinne der Definition in Titel I des Anhangs der Empfehlung 2003/361/EG der Kommission vom 6. Mai 2003 betreffend die Definition der Kleinstunternehmen sowie der kleinen und mittleren Unternehmen (ABl. L 124 vom 20.5.2003, S. 36),
7.
„Kraftfahrzeuge“ Fahrzeuge nach § 1 Absatz 2 und 3 des Straßenverkehrsgesetzes in der Fassung der Bekanntmachung vom 5. März 2003 (BGBl. I S. 310, 919), das zuletzt durch Artikel 2 des Gesetzes vom 23. Februar 2026 (BGBl. 2026 I Nr. 46) geändert worden ist, in der jeweils geltenden Fassung,
8.
„Ladeinfrastruktur“ die Summe aller elektrotechnischen Verbindungen, Mess-, Steuer- und Regelungseinrichtungen, einschließlich Überstrom- und Überspannungsschutzeinrichtungen, die zur Installation, zum Betrieb und zur Steuerung von Ladepunkten für die Elektromobilität notwendig sind,
9.
„Ladepunkt“ eine feste oder mobile, netzgebundene oder netzunabhängige Schnittstelle für die Übertragung von Strom auf ein Elektrofahrzeug, die zwar einen oder mehrere Anschlüsse für unterschiedliche Arten von Anschlüssen haben kann, an der aber zur selben Zeit nur ein Elektrofahrzeug aufgeladen werden kann, mit Ausnahme von Vorrichtungen mit einer Ladeleistung von höchstens 3,7 Kilowatt, deren Hauptzweck nicht das Aufladen von Elektrofahrzeugen ist,
10.
„Leitungsinfrastruktur“ die Gesamtheit aller Leitungsführungen zur Aufnahme von elektro- und datentechnischen Leitungen in Gebäuden oder im räumlichen Zusammenhang von Gebäuden vom Stellplatz über den Zählpunkt eines Anschlussnutzers bis zu den Schutzelementen,
11.
„Nettogrundfläche“ die Nutzfläche eines Nichtwohngebäudes nach DIN/TS 18599-1: 2025-10, die beheizt oder gekühlt wird,
12.
„Nichtwohngebäude“ ein Gebäude, das kein Wohngebäude nach Nummer 15 ist,
13.
„Parkplatz“ eine zusammenhängende Fläche, die aus mehreren Stellplätzen besteht,
14.
„Stellplatz“ eine Fläche, die dem Abstellen eines Kraftfahrzeugs der Klasse M1 oder N1 nach Artikel 4 der Verordnung (EU) 2018/858 außerhalb der öffentlichen Verkehrsflächen dient, wobei Ausstellungs-, Verkaufs-, Werk- und Lagerräume für Kraftfahrzeuge keine Stellplätze sind,
14a.
„Vorverkabelung“ die elektrische Vorbereitung eines Stellplatzes für die spätere Errichtung einer Ladeeinrichtung; sie umfasst alle Maßnahmen, die die Errichtung von Ladeeinrichtungen ermöglichen, einschließlich Datenübertragung, Kabel, Kabelwege und, soweit erforderlich, Stromzählern; sie gilt als umgesetzt, wenn am Stellplatz ein anschlussfähiger Endpunkt wie beispielsweise ein Anschlusskasten, eine Abzweigung oder eine einzelne Zuleitung vorhanden ist, an den die Verbindungsleitung zu einer Ladeeinrichtung ohne weitere Elektroarbeiten angeschlossen werden kann, wobei einerseits Montagearbeiten an der Ladeeinrichtung und die Leitung zwischen Abzweig und Ladeinrichtung nicht als grundlegende Elektroarbeiten gelten und daher nicht erfolgen müssen, andererseits eine reine Grund- oder Sammelinstallation, wie beispielsweise eine Hauptzuleitung, Stromschiene oder ein zentraler Verteiler ohne individuelle Abzweigung oder das Verlegen von Leerrohren oder Kabelkanälen, nicht ausreichend ist,
15.
„Wohngebäude“ ein Gebäude, das nach seiner Zweckbestimmung überwiegend dem Wohnen dient, einschließlich Wohn-, Alten- und Pflegeheimen sowie ähnlicher Einrichtungen.

As from 1 January 2027 the definitions read as follows: no. 3 ("electric vehicle") refers to the Electromobility Act as amended from time to time; no. 4 and no. 11 refer to DIN/TS 18599-1: 2025-10 instead of DIN V 18599: 2018-09; two new definitions are inserted - no. 5a "smart recharging" means a recharging operation in which the intensity of the electricity delivered to the battery is adjusted dynamically on the basis of information communicated electronically, and no. 5b "isolated micro-grid" means a grid with a consumption of less than 500 gigawatt hours in 2022 that is not connected to other grids; no. 7 ("motor vehicles") refers to section 1(2) and (3) of the Road Traffic Act as amended from time to time; no. 9 ("recharging point") means a fixed or mobile, on-grid or off-grid interface for the transfer of electricity to an electric vehicle which may have one or more connectors for different connector types but at which only one electric vehicle can be recharged at a time, with the exception of devices with a recharging power of no more than 3.7 kilowatts whose main purpose is not the recharging of electric vehicles; no. 14 ("parking space") is limited to parking spaces for motor vehicles of category M1 or N1 under Article 4 of Regulation (EU) 2018/858; and the new no. 14a defines "pre-cabling" as the electrical preparation of a parking space for the later installation of a recharging device, comprising all measures that make the installation of recharging devices possible, including data transmission, cables, cable routes and, where necessary, electricity meters; it is deemed to be implemented where a connectable end point such as a junction box, a branch or an individual supply line is present at the parking space to which the connecting line to a recharging device can be connected without further electrical work, whereby assembly work on the recharging device and the line between branch and recharging device do not count as fundamental electrical work, while a mere basic or collective installation such as a main supply line, busbar or central distribution board without an individual branch, or the laying of empty conduits or cable ducts, is not sufficient.

Im Sinne dieses Gesetzes ist oder sind 1.
„Eigentümer“ der Eigentümer des Gebäudes, bei einer Aufteilung nach dem Wohnungseigentumsgesetz auch die Gemeinschaft der Wohnungseigentümer,

„elektrische Infrastruktur“ der Teil der technischen Ausrüstung, der für den Betrieb aller elektrisch oder elektromotorisch betriebenen Anlagen des Gebäudes oder des Parkplatzes notwendig ist, einschließlich der elektrischen Leitungen, der technischen Komponenten und der damit zusammenhängenden Ausstattung,

„Elektromobil“ ein elektrisch betriebenes Fahrzeug nach § 2 Nummer 1 in Verbindung mit § 1 Satz 1 Nummer 1 des Elektromobilitätsgesetzes vom 5. Juni 2015 (BGBl. 12.
„Nichtwohngebäude“ ein Gebäude, das kein Wohngebäude nach Nummer 15 ist,
13.
„Parkplatz“ eine zusammenhängende Fläche, die aus mehreren Stellplätzen besteht,
14.
„Stellplatz“ eine Fläche, die dem Abstellen eines Kraftfahrzeugs der Klasse M1 oder N1 nach Artikel 4 der Verordnung (EU) 2018/858 außerhalb der öffentlichen Verkehrsflächen dient, wobei Ausstellungs-, Verkaufs-, Werk- und Lagerräume für Kraftfahrzeuge keine Stellplätze sind,
14a.
„Vorverkabelung“ die elektrische Vorbereitung eines Stellplatzes für die spätere Errichtung einer Ladeeinrichtung; sie umfasst alle Maßnahmen, die die Errichtung von Ladeeinrichtungen ermöglichen, einschließlich Datenübertragung, Kabel, Kabelwege und, soweit erforderlich, Stromzählern; sie gilt als umgesetzt, wenn am Stellplatz ein anschlussfähiger Endpunkt wie beispielsweise ein Anschlusskasten, eine Abzweigung oder eine einzelne Zuleitung vorhanden ist, an den die Verbindungsleitung zu einer Ladeeinrichtung ohne weitere Elektroarbeiten angeschlossen werden kann, wobei einerseits Montagearbeiten an der Ladeeinrichtung und die Leitung zwischen Abzweig und Ladeinrichtung nicht als grundlegende Elektroarbeiten gelten und daher nicht erfolgen müssen, andererseits eine reine Grund- oder Sammelinstallation, wie beispielsweise eine Hauptzuleitung, Stromschiene oder ein zentraler Verteiler ohne individuelle Abzweigung oder das Verlegen von Leerrohren oder Kabelkanälen, nicht ausreichend ist,
15.
„Wohngebäude“ ein Gebäude, das nach seiner Zweckbestimmung überwiegend dem Wohnen dient, einschließlich Wohn-, Alten- und Pflegeheimen sowie ähnlicher Einrichtungen.

§ 3 — An das Gebäude angrenzende Stellplätze § 3 — Parking spaces adjacent to the building § 3 — An das Gebäude angrenzende Stellplätze

An das Gebäude angrenzende Stellplätze liegen vor, wenn der Parkplatz, auf dem sich die Stellplätze befinden, 1.
denselben Eigentümer wie das Gebäude hat,
2.
überwiegend von den Bewohnern oder Nutzern des Gebäudes genutzt wird und
3.
sich auf dem Grundstück des Gebäudes oder in unmittelbarer Nähe des Gebäudes befindet.

Parking spaces adjacent to the building exist where the car park on which the parking spaces are located 1. has the same owner as the building, 2. is predominantly used by the occupants or users of the building, and 3. is located on the plot of the building or in the immediate vicinity of the building.

An das Gebäude angrenzende Stellplätze liegen vor, wenn der Parkplatz, auf dem sich die Stellplätze befinden, 1.
denselben Eigentümer wie das Gebäude hat,
2.
überwiegend von den Bewohnern oder Nutzern des Gebäudes genutzt wird und
3.
sich auf dem Grundstück des Gebäudes oder in unmittelbarer Nähe des Gebäudes befindet.

§ 4 — Leitungsinfrastruktur § 4 — Ducting infrastructure § 4 — Leitungsinfrastruktur

Die erforderliche Leitungsinfrastruktur umfasst eine geeignete Leitungsführung für Elektro- und Datenleitungen. Die verwendete Leitungsführung muss den dafür geltenden elektro-, bau- und datentechnischen Vorschriften sowie den anerkannten Regeln der Technik genügen. Die Umsetzung kann durch Leerrohre, Kabelschutzrohre, Bodeninstallationssysteme, Kabelpritschen oder vergleichbare Maßnahmen erfolgen. Die erforderliche Leitungsinfrastruktur umfasst mindestens auch den erforderlichen Raum für den Zählerplatz, den Einbau intelligenter Messsysteme für ein Lademanagement und die erforderlichen Schutzelemente. Die Leitungsinfrastruktur sowie die Vorverkabelung müssen so dimensioniert werden, dass die nach diesem Gesetz vorgeschriebene Anzahl von Ladepunkten gleichzeitig und effizient genutzt werden kann. Bei der Vorverkabelung nicht öffentlich zugänglicher Stellplätze ist die Installation eines Lademanagementsystems zu berücksichtigen. Die Sätze 5 und 6 sind nicht anzuwenden, soweit die Einhaltung dieser Anforderungen technisch unmöglich oder wirtschaftlich unzumutbar ist oder anderen öffentlich-rechtlichen Vorschriften widerspricht.

As from 1 January 2027 three sentences are added: the ducting infrastructure and the pre-cabling must be dimensioned in such a way that the number of recharging points prescribed under this Act can be used simultaneously and efficiently. For the pre-cabling of parking spaces that are not publicly accessible, the installation of a load management system must be taken into account. Sentences 5 and 6 do not apply in so far as compliance with these requirements is technically impossible or economically unreasonable or conflicts with other provisions of public law.

Die erforderliche Leitungsinfrastruktur umfasst eine geeignete Leitungsführung für Elektro- und Datenleitungen. Die verwendete Leitungsführung muss den dafür geltenden elektro-, bau- und datentechnischen Vorschriften sowie den anerkannten Regeln der Technik genügen. Bei der Vorverkabelung nicht öffentlich zugänglicher Stellplätze ist die Installation eines Lademanagementsystems zu berücksichtigen. (3) In the cases of subsection (1) or (2), section 10(3) may be applied mutatis mutandis. Where the parking spaces referred to in subsection (1) or (2) are publicly accessible, the owner may also discharge the duties under subsection (1) or (2) by ensuring the installation of publicly accessible recharging points whose total recharging power corresponds to at least the product of the number of publicly accessible parking spaces and a recharging power of 2.2 kilowatts.

(1) Für jedes Nichtwohngebäude, das über mehr als 20 Stellplätze innerhalb des Gebäudes verfügt, hat der Eigentümer dafür zu sorgen, dass ab dem 1. Januar 2027 ein Ladepunkt für jeden zehnten Stellplatz errichtet wird oder mindestens jeweils 50 Prozent der barrierefreien und nicht-barrierefreien Stellplätze mit Leitungsinfrastruktur für die Elektromobilität ausgestattet werden. Abweichend von Satz 1 hat der Eigentümer eines Nichtwohngebäudes, welches sich im Eigentum der öffentlichen Hand befindet und von einer Behörde genutzt wird, dafür zu sorgen, dass ab dem 1. Januar 2033 mindestens jeweils 50 Prozent der barrierefreien und nicht-barrierefreien Stellplätze mit einer Vorverkabelung für die Elektromobilität ausgestattet werden.

(1) For every non-residential building that has more than 20 parking spaces inside the building, the owner must ensure that from 1 January 2027 a recharging point is installed for every tenth parking space or at least 50 per cent of each of the accessible and non-accessible parking spaces are fitted with ducting infrastructure for electromobility. (3) Where an owner has the duty under subsection (1) or (2) for more than one non-residential building, that owner may also discharge the duty by installing the total number of recharging points to be installed together on one or more of the owner's properties, provided that the existing or expected demand for recharging infrastructure on the properties concerned is thereby met. (1) Developers or owners whose buildings are in spatial context may conclude agreements on the joint fitting-out of parking spaces with ducting infrastructure or recharging points in order to meet the respective requirements under sections 6 to 10. Such agreements may relate in particular to 1. the joint fitting-out with ducting infrastructure or the joint installation of recharging points, 2. the use of land, access to it and the routing of lines across land.

For projects whose building application was made by the end of 31 December 2026, the previous requirements continue to apply. The recharging point to be installed in addition when such a residential building is constructed is recorded as a separate obligation.

Conclude a written agreement on joint infrastructure in the neighbourhood -
Description:
Developers or owners whose buildings are in spatial context may conclude agreements on the joint fitting-out of parking spaces with ducting infrastructure or recharging points in order to meet the requirements under sections 6 to 10. Third parties, in particular energy supply undertakings, may be involved. The agreement must be in writing unless another form is prescribed by law and is to be submitted to the competent authority on request. Where the buildings belong to a single owner, a written documentation takes the place of the agreement.
