Any person who commercially carries out works within the scope of the Act on or in a building to be constructed or an existing building must confirm to the owner in writing or electronically, without undue delay after completion of the works, that the works carried out comply with the Act. The duty falls on the undertaking carrying out the works, not on the owner of the building; it is the document by which the owner can later demonstrate compliance with the fitting-out duties.

Wer geschäftsmäßig an oder in einem zu errichtenden oder bestehenden Gebäude Arbeiten im Anwendungsbereich des Gesetzes durchführt, hat dem Eigentümer unverzüglich nach Abschluss der Arbeiten schriftlich oder elektronisch zu bestätigen, dass die von ihm durchgeführten Arbeiten dem Gesetz entsprechen. Die Pflicht trifft das ausführende Unternehmen, nicht den Gebäudeeigentümer; die Erklärung ist das Dokument, mit dem der Eigentümer die Einhaltung der Ausstattungspflichten später nachweisen kann.
