Description (English)
The German Charging Station Ordinance of 23 December 2025 replaced the Charging Station Ordinance of 2016 on 1 January 2026 and is now short: it carries the technical requirements for publicly accessible recharging points for vehicles of categories M and N, and it serves to implement Regulation (EU) 2023/1804 (AFIR). Three duties fall on the operator: every recharging point must meet the applicable technical requirements, in particular those on the technical safety of energy installations under section 49(1) of the Energy Industry Act; commissioning, decommissioning and a change of operator must be notified electronically to the Federal Network Agency within set periods; and compliance with the technical requirements must be evidenced on request. The Federal Network Agency may require retrofitting or prohibit operation of a point. Substantive requirements such as ad hoc payment, price transparency and the connector standards are not repeated here — they follow directly from the AFIR, which the LSV merely enforces.

Die Ladesäulenverordnung vom 23. Dezember 2025 hat zum 1. Januar 2026 die Ladesäulenverordnung von 2016 abgelöst und ist seither kurz: Sie trägt die technischen Anforderungen an öffentlich zugängliche Ladepunkte für Fahrzeuge der Klassen M und N und dient zugleich der Durchführung der Verordnung (EU) 2023/1804 (AFIR). Den Betreiber treffen drei Pflichten: Jeder Ladepunkt muss die geltenden technischen Anforderungen erfüllen, insbesondere die Anforderungen an die technische Sicherheit von Energieanlagen nach § 49 Absatz 1 des Energiewirtschaftsgesetzes; Inbetriebnahme, Außerbetriebnahme und Betreiberwechsel sind der Bundesnetzagentur fristgebunden elektronisch anzuzeigen; und die Einhaltung der technischen Anforderungen ist auf Anforderung nachzuweisen. Die Bundesnetzagentur kann eine Nachrüstung verlangen oder den Betrieb eines Ladepunkts untersagen. Inhaltliche Anforderungen wie Ad-hoc-Zahlung, Preistransparenz und Steckernormen wiederholt die Verordnung nicht — sie ergeben sich unmittelbar aus der AFIR, deren Durchsetzung die LSV lediglich sicherstellt.
