Description (English)
The Federal Network Agency may prohibit the operation of a recharging point where a technical requirement under section 3 or a requirement under Article 5(1), (2), (7), (8) or (10) or Annex II to Regulation (EU) 2023/1804 is not complied with, is not evidenced under section 4(2), or where the notification duty under section 4(1) has not been met. The prohibition is the most severe consequence under the Ordinance; the Charging Station Ordinance contains no administrative fine provision. The Energy Industry Act does not fill that gap: section 95(1) point 5(c) of that Act punishes an infringement of an ordinance only in so far as the ordinance refers, for a specific offence, to that penal provision. The Charging Station Ordinance contains no such reference; its sections 1 to 6 mention the Energy Industry Act only in section 3, and there only for the technical requirements of its section 49. A fine is therefore not possible.

Die Bundesnetzagentur kann den Betrieb eines Ladepunkts untersagen, wenn eine technische Anforderung nach § 3 oder eine Anforderung nach Artikel 5 Absatz 1, 2, 7, 8 oder 10 oder Anhang II der Verordnung (EU) 2023/1804 nicht eingehalten oder nicht nach § 4 Absatz 2 nachgewiesen wird oder der Anzeigepflicht nach § 4 Absatz 1 nicht nachgekommen worden ist. Die Untersagung ist die schärfste Folge der Verordnung; eine Bußgeldvorschrift enthält die Ladesäulenverordnung nicht. Das Energiewirtschaftsgesetz füllt diese Lücke nicht: § 95 Absatz 1 Nummer 5 Buchstabe c EnWG ahndet einen Verstoß gegen eine Rechtsverordnung nur, soweit die Rechtsverordnung für einen bestimmten Tatbestand auf diese Bußgeldvorschrift verweist. Die Ladesäulenverordnung enthält keinen solchen Verweis; ihre §§ 1 bis 6 nennen das Energiewirtschaftsgesetz nur in § 3 und dort allein für die technischen Anforderungen des § 49. Ein Bußgeld ist deshalb nicht möglich.
