Description (English)
The Ordinance implements Regulation (EU) 2024/573 in Germany. Four points matter for operators: national limits on the specific refrigerant loss of stationary refrigeration, air-conditioning and heat pump equipment, graded by date of erection and charge; the duty to ensure access to detachable connections; the duty to have leak checks, recovery and all activities requiring certification carried out only by persons holding a matching certificate of competence and only by undertakings holding a company certificate; and evidence of competence when purchasing fluorinated greenhouse gases or charged equipment. It also governs certificates of competence, refresher courses, the recognition of examining bodies, the certification of undertakings, German-language product information, and the administrative offences. It entered into force on 17 April 2026 and replaces the Chemicals Climate Protection Ordinance of 2 July 2008; transitional provisions run until 12 March 2029.

Die Verordnung führt die Verordnung (EU) 2024/573 in Deutschland durch. Für Anlagenbetreiber sind vier Punkte maßgeblich: nationale Grenzwerte für den spezifischen Kältemittelverlust ortsfester Kälte-, Klima- und Wärmepumpenanlagen, gestaffelt nach Errichtungszeitpunkt und Füllmenge; die Pflicht, den Zugang zu lösbaren Verbindungen sicherzustellen; die Pflicht, Dichtheitskontrolle, Rückgewinnung und alle zertifizierungspflichtigen Tätigkeiten nur von Personen mit passender Sachkundebescheinigung und nur von Unternehmen mit Unternehmenszertifikat ausführen zu lassen; und beim Kauf fluorierter Treibhausgase oder befüllter Einrichtungen der Nachweis der Sachkunde. Daneben regelt sie Sachkundebescheinigungen, Auffrischungskurse, die Anerkennung von Prüfstellen, die Zertifizierung von Unternehmen, deutschsprachige Produktinformationen sowie die Ordnungswidrigkeiten. Sie ist am 17. April 2026 in Kraft getreten und ersetzt die Chemikalien-Klimaschutzverordnung vom 2. Juli 2008; Übergangsvorschriften laufen bis zum 12. März 2029.
