Producers, distributors and third parties appointed by them that take back fluorinated greenhouse gases, and operators of waste treatment facilities disposing of such gases, keep records of the type and quantity of the substances and mixtures taken back or disposed of and of their whereabouts. The records must be kept for at least five years and made available to the competent authority on request. Operators of waste treatment facilities that already keep registers under Section 49 of the Circular Economy Act in conjunction with Part 3 of the Waste Records Ordinance are exempt from the record-keeping duty; instead they additionally state in the register whether recovery or disposal took place and name the substance or substance group under Annex I, II or III of Regulation (EU) 2024/573 — in the field for remarks where the register is kept under Section 24(2), and with the waste code and waste type where it is kept under Section 24(4) and (5).

Hersteller, Vertreiber und von ihnen bestimmte Dritte, die fluorierte Treibhausgase zurücknehmen, sowie Betreiber von Entsorgungsanlagen, die solche Gase entsorgen, führen Aufzeichnungen über Art und Menge der zurückgenommenen oder entsorgten Stoffe und Gemische sowie über deren Verbleib. Die Aufzeichnungen sind mindestens fünf Jahre aufzubewahren und der zuständigen Behörde auf Verlangen zur Verfügung zu stellen. Betreiber von Entsorgungsanlagen, die bereits nach § 49 des Kreislaufwirtschaftsgesetzes in Verbindung mit Teil 3 der Nachweisverordnung Register führen, sind von der Aufzeichnungspflicht ausgenommen; sie geben stattdessen im Register zusätzlich an, ob eine Verwertung oder Beseitigung erfolgt ist, und nennen den entsorgten Stoff oder die Stoffgruppe nach Anhang I, II oder III der Verordnung (EU) 2024/573 — bei Registerführung nach § 24 Absatz 2 der Nachweisverordnung im Feld „Frei für Vermerke“, bei Registerführung nach § 24 Absatz 4 und 5 bei der Angabe des Abfallschlüssels und der Abfallart.
