An activity listed in Article 10(1) of Regulation (EU) 2024/573 may be carried out only by natural persons who hold a certificate of competence covering that activity under Section 6(1), (2), (3) or (6) or Section 7(1), who — where the certificate was issued more than seven years ago — have attended a refresher course no more than seven years ago, who have the necessary technical equipment, and who are reliable. Certificates, training attestations and refresher courses obtained in other Union Member States or States party to the European Economic Area are treated as equivalent. Persons covered by an exemption in an implementing regulation adopted under Article 10(8) of Regulation (EU) 2024/573 are excluded. The refresher course requirement applies only from 13 March 2029; until the end of 12 March 2029 certificates issued under the previous law also remain valid. For the equipment in Article 5(3), first subparagraph, points (b) and (c) of Regulation (EU) 2024/573 — refrigeration units of light commercial refrigerated vehicles, intermodal containers and refrigerated rail wagons, and air-conditioning and heat pumps in heavy duty vehicles, vans, mobile machinery, trains, metros, trams and aircraft — Section 5 applies only from 13 March 2027.

Eine in Artikel 10 Absatz 1 der Verordnung (EU) 2024/573 aufgeführte Tätigkeit darf nur von natürlichen Personen durchgeführt werden, die eine die Tätigkeit abdeckende Sachkundebescheinigung nach § 6 Absatz 1, 2, 3 oder 6 oder nach § 7 Absatz 1 vorweisen können, die — sofern deren Ausstellung länger als sieben Jahre zurückliegt — an einem höchstens sieben Jahre zurückliegenden Auffrischungskurs teilgenommen haben, die über die erforderliche technische Ausstattung verfügen und die zuverlässig sind. In anderen Mitgliedstaaten der Union oder Vertragsstaaten des Europäischen Wirtschaftsraums erworbene Zertifikate, Ausbildungsbescheinigungen und Auffrischungskurse stehen gleich. Ausgenommen sind Personen, für die eine Durchführungsverordnung auf Grundlage des Artikels 10 Absatz 8 der Verordnung (EU) 2024/573 eine Ausnahme vorsieht. Die Voraussetzung des Auffrischungskurses ist erst ab dem 13. März 2029 anzuwenden; bis zum Ablauf des 12. März 2029 gelten außerdem die nach altem Recht ausgestellten Bescheinigungen fort. Für Einrichtungen nach Artikel 5 Absatz 3 Unterabsatz 1 Buchstaben b und c der Verordnung (EU) 2024/573 — Kälteanlagen leichter Kühlfahrzeuge, intermodaler Container und Eisenbahnkühlwaggons sowie Klimaanlagen und Wärmepumpen in schweren Nutzfahrzeugen, Lieferwagen, mobilen Maschinen, Zügen, U-Bahnen, Straßenbahnen und Luftfahrzeugen — ist § 5 erst ab dem 13. März 2027 anzuwenden.
