Legal persons and associations carrying out activities under Article 10(2) of Regulation (EU) 2024/573 require a company certificate for that purpose. Sole traders employing natural persons for such activities may apply for a certificate. Company certificates issued in other Member States or States party to the European Economic Area are treated as equivalent. The competent authority issues the certificate on application where the requirements of Implementing Regulation (EU) 2024/2215 or (EU) 2025/625 are met; the certificate must additionally state the registered office of the undertaking. Undertakings registered under EMAS obtain the certificate where the environmental statement or audit report contains the requirements and the necessary information. Applications must be decided within three months, or within nine months for holders of an old company certificate. The certificate may be refused or withdrawn, in particular in the case of repeated infringements of Regulation (EU) 2024/573. For the equipment in Article 5(3), first subparagraph, points (b) and (c) of Regulation (EU) 2024/573, Section 10 applies only from 13 March 2027.

Juristische Personen und Personenvereinigungen, die Tätigkeiten nach Artikel 10 Absatz 2 der Verordnung (EU) 2024/573 durchführen, bedürfen dafür eines Unternehmenszertifikats. Einzelunternehmen, die natürliche Personen für solche Tätigkeiten beschäftigen, können ein Zertifikat beantragen. In anderen Mitgliedstaaten oder Vertragsstaaten des Europäischen Wirtschaftsraums ausgestellte Unternehmenszertifikate stehen gleich. Die zuständige Behörde erteilt das Zertifikat auf Antrag, wenn die Voraussetzungen der Durchführungsverordnung (EU) 2024/2215 oder (EU) 2025/625 erfüllt sind; im Zertifikat ist zusätzlich der Sitz des Unternehmens anzugeben. Nach EMAS registrierte Unternehmen erhalten das Zertifikat, wenn Umwelterklärung oder Umweltbetriebsprüfungsbericht die Voraussetzungen und die erforderlichen Angaben enthalten. Über den Antrag ist innerhalb von drei Monaten zu entscheiden, bei Inhabern eines alten Unternehmenszertifikats innerhalb von neun Monaten. Das Zertifikat kann versagt oder widerrufen werden, insbesondere bei wiederholten Verstößen gegen die Verordnung (EU) 2024/573. Für Einrichtungen nach Artikel 5 Absatz 3 Unterabsatz 1 Buchstaben b und c der Verordnung (EU) 2024/573 ist § 10 erst ab dem 13. März 2027 anzuwenden.
