Description (English)
Anyone contracting out activities under Article 10(1) or (2) of Regulation (EU) 2024/573 to another undertaking must ensure that it can produce the required certificate of competence or company certificate. Operators of equipment under Article 5(2) or (3) of that Regulation must also ensure that the leak check under Article 5(1) and (6) and the verification under Article 4(5), second subparagraph, are carried out by a natural person holding a matching certificate of competence. Operators of equipment under Article 8(2), (3), (4) and Article 8(10), second subparagraph, must ensure that recovery is carried out by a natural person holding a matching certificate of competence. For the equipment in Article 5(3), first subparagraph, points (b) and (c), Section 14 applies only from 13 March 2027.

Wer Tätigkeiten nach Artikel 10 Absatz 1 oder 2 der Verordnung (EU) 2024/573 einem anderen Unternehmen überträgt, hat sicherzustellen, dass dieses die erforderliche Sachkundebescheinigung oder das erforderliche Unternehmenszertifikat vorweisen kann. Betreiber von Einrichtungen nach Artikel 5 Absatz 2 oder 3 der Verordnung haben außerdem sicherzustellen, dass die Dichtheitskontrolle nach Artikel 5 Absatz 1 und 6 sowie die Prüfung nach Artikel 4 Absatz 5 Unterabsatz 2 von einer natürlichen Person mit passender Sachkundebescheinigung durchgeführt wird. Betreiber von Einrichtungen nach Artikel 8 Absätze 2, 3, 4 und Absatz 10 Unterabsatz 2 der Verordnung haben sicherzustellen, dass die Rückgewinnung von einer natürlichen Person mit passender Sachkundebescheinigung durchgeführt wird. Für Einrichtungen nach Artikel 5 Absatz 3 Unterabsatz 1 Buchstaben b und c gilt § 14 erst ab dem 13. März 2027.
