Description (English)
It is an administrative offence to fail, intentionally or negligently, to take back fluorinated greenhouse gases under Section 4(1), first sentence, or to ensure that a third party does so. The infringement is an administrative offence within the meaning of Section 69(1) no. 8 of the Circular Economy Act and may be fined up to one hundred thousand euro under Section 69(3) of that Act.
Description (German)
Ordnungswidrig handelt, wer vorsätzlich oder fahrlässig entgegen § 4 Absatz 1 Satz 1 fluorierte Treibhausgase nicht zurücknimmt oder die Rücknahme durch einen Dritten nicht sicherstellt. Der Verstoß ist eine Ordnungswidrigkeit im Sinne des § 69 Absatz 1 Nummer 8 des Kreislaufwirtschaftsgesetzes und kann nach § 69 Absatz 3 des Kreislaufwirtschaftsgesetzes mit einer Geldbuße bis zu hunderttausend Euro geahndet werden.
