Description (English)
It is an administrative offence to fail, intentionally or negligently, to keep a record under Section 4(2), first sentence, or to keep it correctly or completely; to fail to retain a record for at least five years under Section 4(2), second sentence; or to contravene an enforceable order under that provision. The infringement is an administrative offence within the meaning of Section 69(2) no. 15 of the Circular Economy Act and may be fined up to ten thousand euro under Section 69(3) of that Act.
Description (German)
Ordnungswidrig handelt, wer vorsätzlich oder fahrlässig entgegen § 4 Absatz 2 Satz 1 eine Aufzeichnung nicht, nicht richtig oder nicht vollständig führt, entgegen § 4 Absatz 2 Satz 2 eine Aufzeichnung nicht oder nicht mindestens fünf Jahre aufbewahrt oder einer vollziehbaren Anordnung nach § 4 Absatz 2 Satz 2 zuwiderhandelt. Der Verstoß ist eine Ordnungswidrigkeit im Sinne des § 69 Absatz 2 Nummer 15 des Kreislaufwirtschaftsgesetzes und kann nach § 69 Absatz 3 des Kreislaufwirtschaftsgesetzes mit einer Geldbuße bis zu zehntausend Euro geahndet werden.
