Description (English)
Administrative fines of up to EUR 15 000 000 or, for undertakings, up to 2.5 % of total worldwide annual turnover for the preceding financial year, whichever is higher, for failure to meet the essential cybersecurity requirements of Annex I or the obligations in Articles 13 and 14.

Geldbuße von bis zu 15 000 000 EUR oder, im Falle von Unternehmen, bis zu 2,5 Prozent des gesamten weltweiten Jahresumsatzes des vorangegangenen Geschäftsjahres — je nachdem, welcher Betrag höher ist. Bewehrt sind die Nichteinhaltung der grundlegenden Cybersicherheitsanforderungen des Anhangs I und Verstöße gegen die Herstellerpflichten des Artikels 13 sowie die Meldepflichten des Artikels 14. Bei der Bemessung sind Art, Schwere und Dauer des Verstoßes, frühere Bußgelder gegen denselben Akteur sowie Größe und Marktanteil zu berücksichtigen. Kleinst- und Kleinunternehmen werden nicht mit einer Geldbuße belegt, soweit es um die 24-Stunden-Frist des Artikels 14 Absatz 2 Buchstabe a oder Absatz 4 Buchstabe a geht; Verwalter quelloffener Software sind von Geldbußen ganz ausgenommen.
