Where the company exceeds the consumption threshold in a given year, that information is made available to the national authorities responsible for implementing Article 11. Member States may provide a new or existing platform for this purpose. The same task applies to both consumption groups: companies above 85 TJ under Article 11(1) and companies above 10 TJ under Article 11(2). The obligation is therefore attached to a rule set that covers both groups through their common lower threshold of more than 10 TJ. Companies between 10 and 85 TJ that operate a certified energy management system are shown as well, although Article 11(3) does not name them; a rule set cannot express the disjunction of the two groups. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Überschreitet das Unternehmen in einem Jahr die Verbrauchsschwelle, so werden diese Informationen den für die Durchführung des Artikels 11 zuständigen nationalen Behörden zur Verfügung gestellt. Die Mitgliedstaaten können dafür eine neue oder bestehende Plattform vorsehen. Dieselbe Aufgabe trifft beide Verbrauchsgruppen: Unternehmen mit mehr als 85 TJ nach Artikel 11 Absatz 1 und Unternehmen mit mehr als 10 TJ nach Artikel 11 Absatz 2. Die Pflicht hängt deshalb an einem Regelwerk, das beide Gruppen über die gemeinsame Untergrenze von mehr als 10 TJ erfasst. Unternehmen zwischen 10 und 85 TJ, die ein zertifiziertes Energiemanagementsystem betreiben, werden dabei mit angezeigt, obwohl Artikel 11 Absatz 3 sie nicht nennt; ein Regelwerk kann die Oder-Verknüpfung der beiden Gruppen nicht abbilden. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
