The owner or operator of the data centre publishes the information set out in Annex VII, for the first time by 15 May 2024 and annually thereafter. Annex VII requires, among other things, the name and location, installed power, data traffic, data stored, energy consumption, power usage effectiveness, temperature set points, waste heat utilisation, water usage and use of renewable energy. Information subject to the protection of trade secrets, business secrets and confidentiality is excluded. Data centres used exclusively for defence or civil protection purposes are outside the obligation (Article 12(2)). The reporting deadlines and the reporting channel do not follow from the Directive but from Delegated Regulation (EU) 2024/1364 adopted under Article 33(3): reporting operators transmit the information and key performance indicators to the European database by 15 September 2024, then by 15 May 2025 and annually thereafter, through a national reporting system where the Member State has set one up and otherwise directly. That Regulation applies directly and does not need to be transposed. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which for this obligation had to be in force by 15 May 2024.

Der Eigentümer oder Betreiber des Rechenzentrums veröffentlicht die in Anhang VII aufgeführten Informationen, erstmals bis zum 15. Mai 2024 und danach jährlich. Anhang VII verlangt unter anderem Angaben zu Name und Standort, installierter Leistung, Datenverkehr, gespeicherten Daten, Energieverbrauch, Energieverbrauchseffektivität, Temperatursollwerten, Abwärmenutzung, Wasserverbrauch und Einsatz erneuerbarer Energie. Informationen, die dem Schutz von Betriebs- und Geschäftsgeheimnissen und der Vertraulichkeit unterliegen, sind ausgenommen. Rechenzentren, die ausschließlich der Verteidigung oder dem Bevölkerungsschutz dienen, fallen nicht unter die Pflicht (Artikel 12 Absatz 2). Die Meldefristen und die Meldeform ergeben sich nicht aus der Richtlinie, sondern aus der auf Artikel 33 Absatz 3 gestützten Delegierten Verordnung (EU) 2024/1364: Die meldenden Betreiber übermitteln die Informationen und wesentlichen Leistungsindikatoren bis zum 15. September 2024, dann bis zum 15. Mai 2025 und danach jedes Jahr an die Europäische Datenbank, über ein nationales Berichterstattungssystem, soweit der Mitgliedstaat ein solches eingerichtet hat, sonst unmittelbar. Diese Verordnung gilt unmittelbar und muss nicht in nationales Recht umgesetzt werden. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das für diese Pflicht bis zum 15. Mai 2024 in Kraft zu setzen war.
