When awarding public contracts and concessions above the EU procurement thresholds, the contracting authority or entity procures only products, services, buildings and works with high energy-efficiency performance in accordance with the Directive's procurement requirements, unless this is not technically feasible. The corrigenda of 3 October 2025 and 7 November 2025 corrected this proviso in the German language version. In addition, for those contracts the contracting authority or entity applies the energy efficiency first principle, including where the Directive lays down no specific procurement requirements. The obligation does not apply where it would undermine public security or impede the response to public health emergencies; it applies only to a limited extent to contracts of the armed forces and not to the supply of military equipment. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Bei der Vergabe öffentlicher Aufträge und Konzessionen oberhalb der unionsrechtlichen Vergabeschwellenwerte beschafft der Auftraggeber nur Produkte, Dienstleistungen, Gebäude und Bauleistungen mit hoher Energieeffizienz nach den Beschaffungsanforderungen der Richtlinie, es sei denn, dies ist technisch nicht durchführbar. Die Berichtigungen vom 3. Oktober 2025 und vom 7. November 2025 haben diese Rückausnahme in der deutschen Sprachfassung richtiggestellt. Zusätzlich wendet der Auftraggeber bei diesen Aufträgen den Grundsatz „Energieeffizienz an erster Stelle“ an, auch dort, wo die Richtlinie keine besonderen Beschaffungsanforderungen vorsieht. Die Pflicht gilt nicht, soweit sie die öffentliche Sicherheit untergraben oder die Reaktion auf Notlagen der öffentlichen Gesundheit beeinträchtigen würde; für Verträge der Streitkräfte gilt sie nur eingeschränkt und für die Lieferung von Militärausrüstung nicht. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
