Where a thermal power generation installation above 10 MW, an industrial installation above 8 MW, a utility installation above 7 MW, or a data centre above 1 MW of average annual total energy input is newly planned or substantially refurbished, a cost-benefit analysis in accordance with Annex XI must be carried out at installation level. Depending on the type of installation, the assessment covers operation as a high-efficiency cogeneration installation, the use of waste heat on site and off site, and connection to a district heating network. For data centres it covers technical feasibility, cost-effectiveness and the effect on energy efficiency and local heat demand, including seasonal variation. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Wird eine thermische Stromerzeugungsanlage mit mehr als 10 MW, eine Industrieanlage mit mehr als 8 MW, eine Versorgungseinrichtung mit mehr als 7 MW oder ein Rechenzentrum mit mehr als 1 MW durchschnittlichem jährlichem Gesamtenergieinput neu geplant oder erheblich modernisiert, so ist auf Anlagenebene eine Kosten-Nutzen-Analyse nach Anhang XI durchzuführen. Bewertet werden je nach Anlagenart der Betrieb als hocheffiziente KWK-Anlage, die Nutzung der Abwärme am Standort und außerhalb sowie der Anschluss an ein Fernwärmenetz. Für Rechenzentren gehören die technische Durchführbarkeit, die Kosteneffizienz und die Auswirkungen auf Energieeffizienz und lokalen Wärmebedarf einschließlich saisonaler Schwankungen dazu. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
