A data centre with a nominal total energy input of more than 1 MW uses the waste heat or other waste heat recovery applications. This is a duty to act on the part of the operator, not merely a duty to assess: it applies continuously for as long as the installation is operated. The only way out is to demonstrate that, in line with the assessment referred to in Article 26(7), this is not technically or economically feasible; that demonstration is the proviso and has to be made and documented, it does not follow by itself. The proviso is deliberately recorded here in the description rather than as a condition in the rule set: whether the demonstration succeeds is the outcome of the cost-benefit analysis and cannot be expressed as an attribute of the company that can be asked for. The rule set is therefore somewhat too wide and also covers data centres that are able to make that demonstration. In German law this obligation corresponds to Section 11(2), point 2, of the Energy Efficiency Act. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Das ist eine Handlungspflicht des Betreibers, nicht nur eine Prüfpflicht: Sie greift dauerhaft, solange die Anlage betrieben wird. Von ihr ist nur befreit, wer nachweist, dass die Nutzung der Abwärme im Einklang mit der Bewertung nach Artikel 26 Absatz 7 technisch oder wirtschaftlich nicht durchführbar ist; dieser Nachweis ist die Rückausnahme und muss geführt und dokumentiert werden, er ergibt sich nicht von selbst. Die Rückausnahme steht bewusst hier in der Beschreibung und nicht als Bedingung im Regelwerk: Ob der Nachweis gelingt, ist das Ergebnis der Kosten-Nutzen-Analyse und lässt sich nicht als abfragbares Merkmal des Unternehmens fassen. Das Regelwerk ist deshalb etwas zu weit und erfasst auch Rechenzentren, die den Nachweis führen können. Im deutschen Recht entspricht dieser Pflicht § 11 Absatz 2 Nummer 2 des Energieeffizienzgesetzes. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
