The company implements an energy management system and has it certified by an independent body in accordance with the relevant European or international standards, in practice EN ISO 50001. The system must be in place by 11 October 2027 at the latest and must then be operated and maintained on an ongoing basis. A company implementing an energy performance contract that covers the necessary elements of the energy management system and complies with Annex XV is exempt (Article 11(10)); so is a company operating a certified environmental management system that includes an energy audit meeting the minimum criteria of Annex VI (Article 11(11)). The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Das System muss spätestens am 11. Oktober 2027 vorhanden sein und danach fortlaufend betrieben und aufrechterhalten werden. Wer einen Energieleistungsvertrag umsetzt, der die erforderlichen Elemente des Energiemanagementsystems abdeckt und Anhang XV entspricht, ist von der Pflicht ausgenommen (Artikel 11 Absatz 10); wer ein zertifiziertes Umweltmanagementsystem betreibt, das ein Energieaudit nach den Mindestkriterien des Anhangs VI umfasst, ebenfalls (Artikel 11 Absatz 11). Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
