The company has an energy audit carried out, either in an independent and cost-effective manner by qualified or accredited experts in accordance with Article 28, or implemented and supervised by independent authorities under national legislation. The first audit must be completed by 11 October 2026 at the latest and subsequent audits at least every four years. A company that already carries out energy audits continues to do so on a four-year cycle. The minimum criteria are set out in Annex VI. An audit under a voluntary agreement within the meaning of Article 11(9) is deemed compliant. A company that implements an energy management system, an energy performance contract complying with Annex XV, or a certified environmental management system including an energy audit is exempt. The Directive is formally addressed to the Member States; the obligation recorded here reaches the company only through national transposing law, which had to be in force by 11 October 2025.

Das Unternehmen lässt ein Energieaudit durchführen, und zwar entweder in unabhängiger und kosteneffizienter Weise durch qualifizierte oder akkreditierte Experten nach Artikel 28 oder durch unabhängige Behörden nach nationalem Recht. Das erste Audit ist spätestens am 11. Oktober 2026 abzuschließen, die weiteren mindestens alle vier Jahre. Wer bereits Energieaudits durchführt, setzt dies im Vierjahresrhythmus fort. Die Mindestkriterien stehen in Anhang VI. Ein Audit im Rahmen einer freiwilligen Vereinbarung nach Artikel 11 Absatz 9 gilt als richtlinienkonform. Wer ein Energiemanagementsystem einrichtet, einen Energieleistungsvertrag nach Anhang XV umsetzt oder ein zertifiziertes Umweltmanagementsystem mit Energieaudit betreibt, ist ausgenommen. Die Richtlinie richtet sich förmlich an die Mitgliedstaaten; die hier erfasste Pflicht trifft das Unternehmen erst über das nationale Umsetzungsrecht, das bis zum 11. Oktober 2025 in Kraft zu setzen war.
