Description (English)
The Act sets German targets for final and primary energy consumption, obliges the Federation and the Länder to achieve annual final energy savings, and lays down company-level duties: an energy or environmental management system for companies consuming more than 7.5 GWh per year, implementation plans for economically viable savings measures for companies above 2.5 GWh, efficiency, waste heat and reporting requirements for data centres and operators of information technology, and duties to avoid, reuse and disclose waste heat. It applies in Germany from 18 November 2023 and has not been amended since. It anticipates parts of the recast Energy Efficiency Directive (EU) 2023/1791 and is stricter than that Directive on thresholds and deadlines, but it does not transpose it in full: public procurement, district heating and network operators are not covered here.

Das Gesetz legt deutsche Ziele für den End- und Primärenergieverbrauch fest, verpflichtet Bund und Länder zu jährlichen Endenergieeinsparungen und enthält Pflichten auf Unternehmensebene: ein Energie- oder Umweltmanagementsystem für Unternehmen mit mehr als 7,5 Gigawattstunden Jahresverbrauch, Umsetzungspläne für wirtschaftliche Einsparmaßnahmen für Unternehmen über 2,5 Gigawattstunden, Effizienz-, Abwärme- und Informationsanforderungen für Rechenzentren und Betreiber von Informationstechnik sowie Pflichten zur Vermeidung, Wiederverwendung und Offenlegung von Abwärme. Es gilt in Deutschland seit dem 18. November 2023 und ist seitdem nicht geändert worden. Es nimmt Teile der Neufassung der Energieeffizienzrichtlinie (EU) 2023/1791 vorweg und ist bei Schwellen und Fristen strenger als diese, setzt sie aber nicht vollständig um: Vergabe, Fernwärme und Netzbetreiber sind hier nicht geregelt.
