Section 10 sentence 2 is first of all a power of the Federal Office for Economic Affairs and Export Control: it checks by sampling whether energy and environmental management systems are implemented and operated and whether implementation plans are drawn up and published, and it is entitled to request evidence for that purpose. A duty of the company arises only with that order; it is subject to a fine under Section 19(1) no. 4 and is therefore recorded here as an event-triggered obligation. If the company is selected, it submits the evidence set out in Annex 2 within four weeks through the electronically available template. Annex 2 requires, among other things, information on the company, on the certification body, on the system in place under ISO 50001 or EMAS and on the date of initial or recertification.

§ 10 Satz 2 ist zunächst eine Befugnis des Bundesamtes für Wirtschaft und Ausfuhrkontrolle: Es kontrolliert die Einrichtung und den Betrieb der Energie- und Umweltmanagementsysteme sowie die Erstellung und Veröffentlichung der Umsetzungspläne durch Stichproben und ist berechtigt, dafür Nachweise zu verlangen. Eine Pflicht des Unternehmens entsteht erst mit dieser Anordnung; sie ist nach § 19 Absatz 1 Nummer 4 bußgeldbewehrt und deshalb hier als ereignisbezogene Pflicht geführt. Wird das Unternehmen ausgewählt, legt es die Nachweise nach der Anlage 2 innerhalb von vier Wochen über die elektronisch abrufbare Vorlage vor. Die Anlage 2 verlangt unter anderem Angaben zum Unternehmen, zur Zertifizierungsgesellschaft, zum eingeführten System nach ISO 50001 oder EMAS und zum Zeitpunkt der Erst- oder Rezertifizierung.
