The operator of a data centre publishes, by the end of 31 March each year, the information set out in Annex 3 for the preceding calendar year and transmits it to the Federation, preferably through the electronic template provided. Annex 3 requires, among other things, information on location and operator, rated connected load, energy demand, power usage effectiveness, share of reused energy and share of renewable energy. Addressees and cut-off dates: the obligation reaches operators in two successive groups. Data centres with a non-redundant rated connected load of 500 kilowatts and above had to transmit for the first time by 15 May 2024; data centres from 200 kilowatts to below 500 kilowatts by 1 July 2025 (Section 20(2)). After that the same annual cut-off date of 31 March applies to both groups. The cut-off dates in Section 20(2) concern only the first transmission; after that the obligation continues to apply to all operators of data centres without change. The obligation is therefore attached to the rule set for operators of data centres, which does not expire.

Der Betreiber eines Rechenzentrums veröffentlicht bis zum Ablauf des 31. März eines jeden Jahres die Informationen nach der Anlage 3 für das vorangegangene Kalenderjahr und übermittelt sie an den Bund, möglichst über die bereitgestellte elektronische Vorlage. Die Anlage 3 verlangt unter anderem Angaben zu Standort und Betreiber, zur Nennanschlussleistung, zum Energiebedarf, zur Energieverbrauchseffektivität, zum Anteil wiederverwendeter Energie und zum Anteil erneuerbarer Energien. Adressatenkreis und Stichtage: Die Pflicht trifft die Betreiber nacheinander in zwei Gruppen. Rechenzentren mit einer nicht redundanten Nennanschlussleistung ab 500 Kilowatt mussten erstmals bis zum 15. Mai 2024 übermitteln, Rechenzentren von 200 Kilowatt bis unter 500 Kilowatt erstmals bis zum 1. Juli 2025 (§ 20 Absatz 2). Danach gilt für beide Gruppen derselbe jährliche Stichtag 31. März. Die Stichtage des § 20 Absatz 2 betreffen nur die erste Übermittlung; danach gilt die Pflicht für alle Betreiber von Rechenzentren unverändert fort. Die Pflicht hängt deshalb am Regelwerk der Betreiber von Rechenzentren, das nicht ausläuft.
