Description (English)
The company avoids the waste heat arising in its operations in line with the state of the art and reduces the waste heat arising to the share that is technically unavoidable, in so far as this is possible and reasonable. Technical, economic and operational considerations are taken into account in assessing reasonableness. The state of the art is determined from the BAT conclusions in force under Directive 2010/75/EU as regards waste heat. The obligation does not apply to installations requiring a permit under Section 4 of the Federal Immission Control Act in so far as more specific requirements exist there (Section 16(3)). Reasonableness cannot be assessed automatically; it depends on information about the specific operation.
Description (German)
Das Unternehmen vermeidet die in seinem Betrieb entstehende Abwärme nach dem Stand der Technik und reduziert die anfallende Abwärme auf den Anteil der technisch unvermeidbaren Abwärme, soweit dies möglich und zumutbar ist. Im Rahmen der Zumutbarkeit sind technische, wirtschaftliche und betriebliche Belange zu berücksichtigen. Für den Stand der Technik sind die jeweils geltenden BVT-Schlussfolgerungen nach der Richtlinie 2010/75/EU in Bezug auf Abwärme heranzuziehen. Die Pflicht gilt nicht für Anlagen, die nach § 4 des Bundes-Immissionsschutzgesetzes genehmigungsbedürftig sind, soweit dort speziellere Anforderungen bestehen (§ 16 Absatz 3). Die Zumutbarkeit lässt sich nicht maschinell prüfen; sie setzt Angaben über den konkreten Betrieb voraus.
