The supplier must not place on the market products designed to alter a model's performance automatically under test conditions in order to reach a more favourable result for the parameters declared in the delegated act or in the product documentation (Article 3(5)). The prohibition concerns product design and firmware, not the sales process.

Der Lieferant darf keine Produkte in Verkehr bringen, die so gestaltet sind, dass die Leistung eines Modells unter Testbedingungen automatisch verändert wird, um bei den im delegierten Rechtsakt oder in den Produktunterlagen angegebenen Parametern ein günstigeres Ergebnis zu erzielen (Artikel 3 Absatz 5).
