Where the dealer does not have a label, it requests one from the supplier (Article 5(2)); the supplier must deliver it free of charge and within five working days (Article 3(2)). Where it does not have a product information sheet, it likewise requests one from the supplier or — if it prefers — prints one from the product database or downloads one for electronic display, where those functions are available for the product (Article 5(3)). The duty applies irrespective of the fact that the supplier should already have supplied the label under Article 3(1); a missing label does not relieve the dealer.

Verfügt er über kein Produktdatenblatt, fordert er es ebenfalls beim Lieferanten an oder druckt es — wenn er das vorzieht — aus der Produktdatenbank aus beziehungsweise lädt es zur elektronischen Anzeige herunter, soweit diese Funktionen für das Produkt verfügbar sind (Artikel 5 Absatz 3). Die Pflicht besteht unabhängig davon, dass der Lieferant das Etikett schon nach Artikel 3 Absatz 1 hätte mitliefern müssen; ein fehlendes Etikett entlastet den Händler nicht.
