Description (English)
The Regulation does not itself lay down a penalty. Article 7(4) requires Member States to lay down rules on penalties and enforcement mechanisms for infringements of the Regulation and of the delegated acts; these must be effective, proportionate and dissuasive. What penalty applies in an individual case therefore follows from national law. In Germany not every duty under this Regulation is backed by a fine — section 8 of the Energy Labelling Ordinance (EnVKV) lists the administrative offences exhaustively and refers for them solely to section 15(1) no. 1 of the Energy Labelling Act (EnVKG); the fine is up to EUR 50,000 (section 15(2) EnVKG). Each of those offences attaches to a provision of the EnVKV itself. For directly applicable Union law, section 15(1) no. 5 EnVKG requires a separate reference in an ordinance under section 15(3) EnVKG; the EnVKV contains no such reference. Duties that follow from this Regulation alone — registration in the product database under Article 4, Article 3(4) and (5) and Article 6(b) — and the product groups of Delegated Regulations (EU) 2023/1669 (smartphones and slate tablets) and (EU) 2023/2534 (household tumble dryers), which Annex 2 Section 1(1) EnVKV does not list, are therefore not backed by a fine under section 8 EnVKV. They are enforced through market surveillance orders under section 10 EnVKG; only a breach of an enforceable order is an administrative offence under section 15(1) no. 2 EnVKG. Whether Annex 2 EnVKV can be read dynamically to cover later delegated acts is a question of interpretation; the principle of legal certainty in administrative-offence law argues against it. Neither the amount nor the competent authority is set out in this Regulation.

Die Verordnung legt selbst keine Sanktion fest. Artikel 7 Absatz 4 verpflichtet die Mitgliedstaaten, für Verstöße gegen die Verordnung und die delegierten Rechtsakte Sanktionen und Durchsetzungsmechanismen festzulegen; sie müssen wirksam, verhältnismäßig und abschreckend sein. Welche Sanktion im Einzelfall droht, ergibt sich deshalb aus dem nationalen Recht. In Deutschland ist nicht jede Pflicht dieser Verordnung mit einem Bußgeld bewehrt — § 8 der Energieverbrauchskennzeichnungsverordnung (EnVKV) zählt die Ordnungswidrigkeiten abschließend auf und verweist dafür allein auf § 15 Absatz 1 Nummer 1 des Energieverbrauchskennzeichnungsgesetzes (EnVKG); die Geldbuße beträgt bis zu 50 000 Euro (§ 15 Absatz 2 EnVKG). Jeder dieser Tatbestände knüpft an eine Vorschrift der EnVKV selbst an. Für unmittelbar geltendes Unionsrecht verlangt § 15 Absatz 1 Nummer 5 EnVKG einen eigenen Verweis in einer Rechtsverordnung nach § 15 Absatz 3 EnVKG; einen solchen Verweis enthält die EnVKV nicht. Pflichten, die allein aus dieser Verordnung folgen — die Eintragung in die Produktdatenbank nach Artikel 4, Artikel 3 Absätze 4 und 5 sowie Artikel 6 Buchstabe b —, und die Produktgruppen der Delegierten Verordnungen (EU) 2023/1669 (Smartphones und Slate-Tablets) und (EU) 2023/2534 (Haushaltswäschetrockner), die Anlage 2 Abschnitt 1 Absatz 1 EnVKV nicht aufführt, sind deshalb über § 8 EnVKV nicht bußgeldbewehrt. Durchgesetzt werden sie über Anordnungen der Marktüberwachung nach § 10 EnVKG; erst wer einer vollziehbaren Anordnung zuwiderhandelt, handelt nach § 15 Absatz 1 Nummer 2 EnVKG ordnungswidrig. Ob Anlage 2 EnVKV dynamisch auf später erlassene delegierte Rechtsakte gelesen werden kann, ist eine Auslegungsfrage; wegen des Bestimmtheitsgebots im Ordnungswidrigkeitenrecht spricht mehr dagegen. Die Höhe und die zuständige Behörde stehen nicht in dieser Verordnung.
