Description (English)
Where the supplier or the dealer does not take adequate corrective action within the period set by the market surveillance authority, the authorities take provisional measures: they prohibit or restrict the availability of the product on their national market, withdraw it from the market or recall it (Article 9(5)). For a retail chain this is the most far-reaching consequence in practice — it hits the product range directly, not just the balance sheet.

Ergreift der Lieferant oder der Händler innerhalb der von der Marktüberwachungsbehörde gesetzten Frist keine angemessenen Abhilfemaßnahmen, treffen die Behörden vorläufige Maßnahmen: Sie untersagen oder beschränken die Verfügbarkeit des Produkts auf dem nationalen Markt, nehmen es vom Markt oder rufen es zurück (Artikel 9 Absatz 5). Für eine Handelskette ist das die praktisch einschneidendste Folge — sie trifft das Sortiment unmittelbar und nicht erst die Kasse.
