Description (English)
The Pay Transparency Act is intended to enforce the requirement of equal pay for women and men for equal or equivalent work. It prohibits direct and indirect pay discrimination on grounds of sex, requires the employer to operate a pay system free of discrimination and works with three instruments of differing reach: an individual right to information for employees in establishments and administrative units with, as a rule, more than 200 employees; a company review procedure which private employers with, as a rule, more than 500 employees are merely called upon to carry out; and a binding reporting duty for employers with, as a rule, more than 500 employees which are obliged to draw up a management report, on a three-year cycle, or five years where the employer is bound by a collective agreement, or applies one and has made the declaration under section 13(5). The Act contains no provision on fines; it is enforced through the invalidity of agreements to the contrary and through a reversal of the burden of proof against an employer which fails to provide information. It has applied since 6 July 2017; the only amendment concerns, since 1 August 2022, the place where the report is disclosed. The Act does not implement the Pay Transparency Directive (EU) 2023/970, whose transposition deadline expired on 7 June 2026.

Das Entgelttransparenzgesetz soll das Gebot des gleichen Entgelts für Frauen und Männer bei gleicher oder gleichwertiger Arbeit durchsetzen. Es verbietet die unmittelbare und mittelbare Entgeltbenachteiligung wegen des Geschlechts, verlangt vom Arbeitgeber ein benachteiligungsfreies Entgeltsystem und arbeitet mit drei Instrumenten unterschiedlicher Reichweite: einem individuellen Auskunftsanspruch der Beschäftigten in Betrieben und Dienststellen mit in der Regel mehr als 200 Beschäftigten, einem betrieblichen Prüfverfahren, zu dem private Arbeitgeber mit in der Regel mehr als 500 Beschäftigten lediglich aufgefordert sind, und einer verbindlichen Berichtspflicht für lageberichtspflichtige Arbeitgeber mit in der Regel mehr als 500 Beschäftigten im Turnus von drei Jahren, bei Tarifbindung oder bei Tarifanwendung mit Erklärung nach § 13 Absatz 5 von fünf Jahren. Das Gesetz enthält keine Bußgeldvorschrift; durchgesetzt wird es über die Unwirksamkeit entgegenstehender Vereinbarungen und über eine Beweislastumkehr zu Lasten des Arbeitgebers, der die Auskunft unterlässt. Es gilt seit dem 6. Juli 2017; die einzige Änderung betrifft seit dem 1. August 2022 den Ort der Offenlegung des Berichts. Das Gesetz setzt die Entgelttransparenzrichtlinie (EU) 2023/970 nicht um, deren Umsetzungsfrist am 7. Juni 2026 ablief.
