Description (English)
For equal or equivalent work no lower pay may be agreed or paid on grounds of sex; this covers all pay components and pay conditions and includes both direct and indirect discrimination, expressly also lower pay of a woman on grounds of pregnancy or maternity (section 3(1) and (2), section 7). Where the employer uses a pay system, that system as a whole and each individual component must be designed so that discrimination on grounds of sex is ruled out: it must take objective account of the nature of the activity, be based on criteria common to female and male employees, weight the differentiating criteria free of discrimination and be transparent overall (section 4(4)). Whether activities are equal or equivalent follows from section 4(1) and (2) on the basis of a totality of factors, including the nature of the work, the training requirements and the working conditions. Indirect discrimination is justified where the arrangement serves a legitimate aim and is proportionate; criteria relating to the labour market, to performance and to work results may qualify (section 3(3)). A presumption of appropriateness applies to pay arrangements in collective agreements and in statute (section 4(5) and (6)). Agreements to the contrary are invalid (section 8(1)). Für gleiche oder gleichwertige Arbeit darf wegen des Geschlechts kein geringeres Entgelt vereinbart oder gezahlt werden; das gilt für sämtliche Entgeltbestandteile und Entgeltbedingungen und erfasst unmittelbare wie mittelbare Benachteiligung, ausdrücklich auch das geringere Entgelt einer Frau wegen Schwangerschaft oder Mutterschaft (§ 3 Absatz 1 und 2, § 7). Verwendet der Arbeitgeber ein Entgeltsystem, muss dieses als Ganzes und in jedem einzelnen Bestandteil so ausgestaltet sein, dass eine Benachteiligung wegen des Geschlechts ausgeschlossen ist: Es muss die Art der Tätigkeit objektiv berücksichtigen, auf gemeinsamen Kriterien für weibliche und männliche Beschäftigte beruhen, die Differenzierungskriterien diskriminierungsfrei gewichten und insgesamt durchschaubar sein (§ 4 Absatz 4). Ob Tätigkeiten gleich oder gleichwertig sind, richtet sich nach § 4 Absatz 1 und 2 nach einer Gesamtheit von Faktoren, darunter Art der Arbeit, Ausbildungsanforderungen und Arbeitsbedingungen. Eine mittelbare Benachteiligung ist gerechtfertigt, wenn die Regelung einem rechtmäßigen Ziel dient und verhältnismäßig ist; arbeitsmarkt-, leistungs- und arbeitsergebnisbezogene Kriterien kommen dafür in Betracht (§ 3 Absatz 3). Für tarifvertragliche und gesetzliche Entgeltregelungen gilt eine Angemessenheitsvermutung (§ 4 Absatz 5 und 6). Entgegenstehende Vereinbarungen sind unwirksam (§ 8 Absatz 1).
