Description (English)
The employer takes the necessary measures to protect employees against discrimination on grounds of sex in relation to pay; that protection expressly covers preventive measures such as training for managers, rules for salary negotiations and a complaints procedure (section 6(2)). This includes, as a duty to refrain, the prohibition of retaliation: employees may not be disadvantaged because they exercise rights under this Act, and the same applies to persons who support them or give evidence as witnesses (section 9). The use of information obtained through a request for information is limited to asserting rights under this Act; publication of personal salary data and disclosure to third parties are not covered (section 8(2)). Der Arbeitgeber trifft die erforderlichen Maßnahmen, um die Beschäftigten vor Benachteiligungen wegen des Geschlechts in Bezug auf das Entgelt zu schützen; der Schutz umfasst ausdrücklich auch vorbeugende Maßnahmen, etwa Schulung der Führungskräfte, Vorgaben für Gehaltsverhandlungen und ein Verfahren für Beschwerden (§ 6 Absatz 2). Dazu gehört als Unterlassungspflicht das Maßregelungsverbot: Beschäftigte dürfen nicht benachteiligt werden, weil sie Rechte nach diesem Gesetz in Anspruch nehmen; das gilt auch für Personen, die sie dabei unterstützen oder als Zeuginnen oder Zeugen aussagen (§ 9). Die Nutzung der aus einem Auskunftsverlangen erlangten Informationen ist auf die Geltendmachung von Rechten nach diesem Gesetz beschränkt; Veröffentlichung personenbezogener Gehaltsangaben und Weitergabe an Dritte sind nicht gedeckt (§ 8 Absatz 2).
