Employees may request in text form information on the criteria and procedures for determining pay and on the comparable pay for an equal or equivalent activity they name, relating to the average monthly gross pay and up to two individual pay components (section 10(1) and (2), section 11(1) and (2)). The comparable pay must be stated as the statistical median extrapolated to full-time equivalents, related to one calendar year (section 11(3)). Who answers depends on collective agreement status: at employers bound by or applying a collective agreement the employees address the works council and the employer may assume performance; where there is no works council they address the employer (section 14). In that case the employer informs the representatives of the competent parties to collective agreements of its answer and, where they assume the answering, makes the necessary information available to them. At employers neither bound by nor applying a collective agreement they address the employer (section 15(1) and (2)). Executive staff always address the employer (section 13(4)). In the public service the right applies accordingly in administrative units with, as a rule, more than 200 employees (section 16). Under section 15(3) the answer must be given in text form within three months of receipt; where the deadline is at risk of being missed the employee must be informed and the answer given without further delay. Where the employer does not consider the activity named to be equal or equivalent, it must give comprehensible reasons by reference to the standards applied in the establishment and relate its answer to an activity it considers comparable (section 15(4)). Limits: the information covers only pay arrangements of the same establishment and employer, no arrangements differing between regions and no comparison between the groups of employees listed in section 5(2); the comparable pay is not to be stated where the comparable activity is performed by fewer than six employees of the other sex (section 12(2) and (3)). Repeat requests are possible only after two years unless the circumstances have changed materially (section 10(2)). Beschäftigte können in Textform Auskunft zu den Kriterien und Verfahren der Entgeltfindung und zum Vergleichsentgelt für eine von ihnen benannte gleiche oder gleichwertige Tätigkeit verlangen, bezogen auf das durchschnittliche monatliche Bruttoentgelt und bis zu zwei einzelne Entgeltbestandteile (§ 10 Absatz 1 und 2, § 11 Absatz 1 und 2). Das Vergleichsentgelt ist als auf Vollzeitäquivalente hochgerechneter statistischer Median, bezogen auf ein Kalenderjahr, anzugeben (§ 11 Absatz 3). Wer die Auskunft erteilt, hängt von der Tarifbindung ab: Bei tarifgebundenen und tarifanwendenden Arbeitgebern wenden sich die Beschäftigten an den Betriebsrat, der Arbeitgeber kann die Erfüllung übernehmen; besteht kein Betriebsrat, wenden sie sich an den Arbeitgeber (§ 14). In diesem Fall informiert der Arbeitgeber die Vertreterinnen und Vertreter der zuständigen Tarifvertragsparteien über seine Antwort und stellt ihnen, wenn sie die Beantwortung übernehmen, die erforderlichen Informationen bereit. Bei nicht tarifgebundenen und nicht tarifanwendenden Arbeitgebern wenden sie sich an den Arbeitgeber (§ 15 Absatz 1 und 2). Leitende Angestellte wenden sich stets an den Arbeitgeber (§ 13 Absatz 4). Im öffentlichen Dienst gilt der Anspruch in Dienststellen mit in der Regel mehr als 200 Beschäftigten entsprechend (§ 16). Die Antwort ist nach § 15 Absatz 3 innerhalb von drei Monaten nach Zugang in Textform zu erteilen; droht Fristversäumnis, ist die oder der Beschäftigte zu informieren und die Antwort ohne weiteres Verzögern zu erteilen. Hält der Arbeitgeber die benannte Tätigkeit nicht für gleich oder gleichwertig, muss er das anhand der im Betrieb angewendeten Maßstäbe nachvollziehbar begründen und die Auskunft auf eine aus seiner Sicht vergleichbare Tätigkeit beziehen (§ 15 Absatz 4). Grenzen: Die Auskunft umfasst nur Entgeltregelungen desselben Betriebs und Arbeitgebers, keine regional unterschiedlichen Regelungen und keinen Vergleich zwischen den Beschäftigtengruppen des § 5 Absatz 2; das Vergleichsentgelt ist nicht anzugeben, wenn die Vergleichstätigkeit von weniger als sechs Beschäftigten des jeweils anderen Geschlechts ausgeübt wird (§ 12 Absatz 2 und 3). Wiederholte Verlangen sind erst nach zwei Jahren möglich, es sei denn, die Voraussetzungen haben sich wesentlich verändert (§ 10 Absatz 2). The answer is given to the employee in text form (section 15(3)) and is thereby documented. Where the employer fails to provide the information, it bears the burden of proof in a dispute that there is no infringement of the equal pay requirement (section 15(5)).
