Description (English)
So that the works council can perform its task in the information procedure, the employer grants the works committee access to the lists of gross wages and salaries and breaks those lists down. The lists must contain, broken down by sex, all pay components including supplements above the collectively agreed level and individually negotiated payments, and must be prepared so that the works committee can provide the information properly (section 13(3)). The employer declares to the works council in writing or in text form whether collectively agreed pay arrangements are applied in accordance with section 5(5) (section 13(5)). Where the employer assumes the answering, it informs the works council comprehensively and in good time of the requests received and of its answer, and the employees must be informed who provides the information (section 14(2)). The employer likewise makes the necessary information available to the works council upon request (section 15(4) sentence 5). Further references: section 13(5), section 14(2), section 15(4).

Damit der Betriebsrat seine Aufgabe im Auskunftsverfahren erfüllen kann, gewährt der Arbeitgeber dem Betriebsausschuss Einblick in die Listen über die Bruttolöhne und -gehälter und schlüsselt diese auf. Die Listen müssen nach Geschlecht aufgeschlüsselt alle Entgeltbestandteile enthalten, einschließlich übertariflicher Zulagen und individuell ausgehandelter Zahlungen, und so aufbereitet sein, dass der Betriebsausschuss die Auskunft ordnungsgemäß erfüllen kann (§ 13 Absatz 3). Der Arbeitgeber erklärt gegenüber dem Betriebsrat schriftlich oder in Textform, ob tarifliche Entgeltregelungen entsprechend § 5 Absatz 5 angewendet werden (§ 13 Absatz 5). Übernimmt der Arbeitgeber die Beantwortung, informiert er den Betriebsrat umfassend und rechtzeitig über eingehende Verlangen und über seine Antwort, und die Beschäftigten sind darüber zu informieren, wer die Auskunft erteilt (§ 14 Absatz 2).
