Private employers are called upon to review their pay arrangements, the various pay components paid and their application regularly for compliance with the equal pay requirement by means of company review procedures (section 17(1)). The provision is framed as a call and not as an enforceable duty; where a review procedure is carried out, however, the requirements of section 18 are binding. The procedure is carried out under the employer's own responsibility and with the involvement of the workplace employee representative bodies (section 17(2)). It must consist of a stocktake, an analysis and a report on the results; the employer is free in its choice of analysis methods and job evaluation procedures but must use valid statistical methods, break the data down by sex and preserve the protection of personal data (section 18(2)). All activities subject to the same pay system must be covered, irrespective of the legal basis (section 18(1)). For statutory and collectively agreed pay arrangements there is no obligation to review the equivalence of activities (section 18(3)). Within a group the controlling undertaking may carry out the procedure for all group undertakings where it exercises decisive influence on the pay conditions of at least one group undertaking (section 17(1) sentence 2). Private Arbeitgeber sind aufgefordert, ihre Entgeltregelungen, die verschiedenen gezahlten Entgeltbestandteile und deren Anwendung mithilfe betrieblicher Prüfverfahren regelmäßig auf die Einhaltung des Entgeltgleichheitsgebots zu überprüfen (§ 17 Absatz 1). Die Vorschrift ist als Aufforderung und nicht als durchsetzbare Pflicht formuliert; wird ein Prüfverfahren durchgeführt, gelten die Vorgaben des § 18 jedoch verbindlich. Das Verfahren erfolgt in eigener Verantwortung des Arbeitgebers und unter Beteiligung der betrieblichen Interessenvertretungen (§ 17 Absatz 2). Es muss aus Bestandsaufnahme, Analyse und Ergebnisbericht bestehen; der Arbeitgeber ist in der Wahl von Analysemethoden und Arbeitsbewertungsverfahren frei, muss aber valide statistische Methoden verwenden, die Daten nach Geschlecht aufschlüsseln und den Schutz personenbezogener Daten wahren (§ 18 Absatz 2). Einzubeziehen sind alle Tätigkeiten, die demselben Entgeltsystem unterliegen, unabhängig von der Rechtsgrundlage (§ 18 Absatz 1). Bei gesetzlichen und tarifvertraglichen Entgeltregelungen besteht keine Verpflichtung zur Überprüfung der Gleichwertigkeit von Tätigkeiten (§ 18 Absatz 3). Im Konzern kann das herrschende Unternehmen das Verfahren für alle Konzernunternehmen durchführen, wenn es auf die Entgeltbedingungen mindestens eines Konzernunternehmens entscheidenden Einfluss nimmt (§ 17 Absatz 1 Satz 2).
