The report under section 21 is attached as an annex to the next management report under section 289 of the Commercial Code following the respective reporting period. The duty is thereby tied to the commercial-law rhythm of management reporting and not to the reporting cycle under section 22(1) or (2): the report is drawn up every three or five years and attached to the next management report that follows. Since the version applicable from 1 August 2022 the report is disclosed in the Company Register; before that it had to be published in the Federal Gazette. The amended version applies for the first time to reports to be attached to management reports for a financial year beginning after 31 December 2021 (section 25(4)).

Der Bericht nach § 21 wird dem nächsten Lagebericht nach § 289 des Handelsgesetzbuches, der dem jeweiligen Berichtszeitraum folgt, als Anlage beigefügt. Die Pflicht ist damit an den handelsrechtlichen Rhythmus der Lageberichterstattung gekoppelt und nicht an den Berichtsturnus nach § 22 Absatz 1 oder 2: Erstellt wird der Bericht alle drei oder fünf Jahre, beigefügt wird er dem nächsten darauf folgenden Lagebericht. Seit der ab 1. August 2022 geltenden Fassung wird der Bericht im Unternehmensregister offengelegt; zuvor war er im Bundesanzeiger zu veröffentlichen. Die geänderte Fassung ist erstmals auf Berichte anzuwenden, die Lageberichten für ein nach dem 31. Dezember 2021 beginnendes Geschäftsjahr beizufügen sind (§ 25 Absatz 4).
