Description (English)
Provisions in agreements which infringe the prohibition of discrimination or the equal pay requirement are invalid. The person discriminated against may claim the higher pay of the comparison group; the claim is enforced before the labour courts. The Act provides for no fine, no administrative penalty payment and no sanction by an authority.

Bestimmungen in Vereinbarungen, die gegen das Benachteiligungsverbot oder das Entgeltgleichheitsgebot verstoßen, sind unwirksam. Die benachteiligte Person kann das höhere Entgelt der Vergleichsgruppe verlangen; durchgesetzt wird der Anspruch vor den Arbeitsgerichten. Das Gesetz sieht daneben keine Geldbuße, kein Ordnungsgeld und keine behördliche Sanktion vor.
