The Act entered into force on 6 July 2017. It was adopted as Article 1 of the Act to Promote Transparency of Pay Structures between Women and Men of 30 June 2017 (Federal Law Gazette I p. 2152) and entered into force under Article 3 of that Act on the day after promulgation. The text of the Act itself names that date in its transitional provision.
The report on equality and equal pay had to be drawn up for the first time in 2018. The reporting period of the first report covered only the last completed calendar year before 2017.
The individual right to information under section 10 could be asserted for the first time six calendar months after 6 July 2017, that is from 6 January 2018.
End of the transitional rule on repeating a request for information: an employee who asserted the right for the first time within three calendar years of the earliest possible date could, by way of derogation from the two-year period, request information again only after three calendar years. The date is the end of the third calendar year after 6 January 2018 and is not stated expressly in the Act.
The amended disclosure provision applies for the first time to reports to be attached to management reports for a financial year beginning after 31 December 2021. The earliest financial year concerned begins on 1 January 2022.
The version of section 22(4) amended by Article 25 of the Act implementing the Digitalisation Directive of 5 July 2021 has applied since 1 August 2022. Since then the report is disclosed in the Company Register and no longer published in the Federal Gazette.
