German implementing ordinance on energy labelling. It allocates the duties between supplier and dealer, determines where the label must be shown at the point of sale and online, what must appear in advertising and in technical promotional material, and what technical documentation the supplier must keep, and makes all of that an administrative offence in section 8, punishable by a fine of up to EUR 50,000 (section 15(2) of the Energy Labelling Act). Which products must be labelled is not set out here but in the EU delegated regulations listed in Annex 2. The text of the Ordinance still refers throughout to Directive 2010/30/EU, although that Directive was repealed on 1 August 2017 and replaced by Regulation (EU) 2017/1369. Annex 2 has not been updated since the amendment of 19 February 2021. It lists twenty delegated regulations and covers neither smartphones and slate tablets (Delegated Regulation (EU) 2023/1669, applicable from 20 June 2025) nor household tumble dryers under Delegated Regulation (EU) 2023/2534 (applicable from 1 July 2025); point 6 still names Delegated Regulation (EU) No 392/2012, which was repealed by Article 8 of Delegated Regulation (EU) 2023/2534. For those product groups the European labelling duty applies directly under the delegated regulation, but the fine under section 8 of this Ordinance does not apply, or applies only doubtfully, because the offence is tied to Annex 2.

Description (German)

Deutsche Durchführungsverordnung zur Energieverbrauchskennzeichnung. Sie verteilt die Pflichten zwischen Lieferant und Händler, bestimmt, wo das Etikett am Verkaufsort und im Internet zu zeigen ist, was in Werbung und technischen Werbeschriften stehen muss, welche technische Dokumentation der Lieferant vorhält, und bewehrt all das in § 8 als Ordnungswidrigkeit mit einer Geldbuße bis zu 50 000 Euro (§ 15 Absatz 2 EnVKG). Welche Produkte im Einzelnen zu kennzeichnen sind, steht nicht hier, sondern in den delegierten Verordnungen der EU, die Anlage 2 aufzählt. Der Verordnungstext nimmt noch durchgehend auf die Richtlinie 2010/30/EU Bezug, obwohl diese seit dem 1. August 2017 aufgehoben und durch die Verordnung (EU) 2017/1369 ersetzt ist. Anlage 2 ist seit der Änderung vom 19. Februar 2021 nicht nachgeführt. Sie zählt zwanzig Delegierte Verordnungen auf und erfasst weder Smartphones und Slate-Tablets (Delegierte Verordnung (EU) 2023/1669, anwendbar ab dem 20. Juni 2025) noch Haushaltswäschetrockner nach der Delegierten Verordnung (EU) 2023/2534 (anwendbar ab dem 1. Juli 2025); Nummer 6 nennt weiterhin die Delegierte Verordnung (EU) Nr. 392/2012, die durch Artikel 8 der Delegierten Verordnung (EU) 2023/2534 aufgehoben worden ist. Für diese Produktgruppen gilt die europäische Kennzeichnungspflicht unmittelbar aus der Delegierten Verordnung; die Bußgeldbewehrung des § 8 dieser Verordnung greift dort jedoch nicht oder nur zweifelhaft, weil der Bußgeldtatbestand an die Anlage 2 anknüpft.
