Where a labelling duty exists under section 3, the supplier draws up technical documentation for each product model by which the accuracy of the data on the label and in the information sheet can be verified (section 6(1)). It may use documents already required under Union law and keeps the documentation available for five years after the end of production of the model (section 6(2)). On request it makes the documentation available in electronic form within ten working days to the competent market surveillance authorities, to the authorities of other Member States or EEA States and to the European Commission (section 6(3)). The supplier is responsible for the accuracy of the data on labels and information sheets; its consent to publication of that data is deemed given (section 3(3), sentence 1).

Besteht eine Kennzeichnungspflicht nach § 3, erstellt der Lieferant für jedes Produktmodell eine technische Dokumentation, anhand deren sich die Richtigkeit der Angaben auf Etikett und Datenblatt überprüfen lässt (§ 6 Absatz 1). Er darf dafür Unterlagen verwenden, die das Unionsrecht ohnehin verlangt, und hält die Dokumentation fünf Jahre nach dem Ende der Herstellung des Modells bereit (§ 6 Absatz 2). Auf Verlangen stellt er sie den zuständigen Marktüberwachungsbehörden, den Behörden anderer Mitgliedstaaten oder EWR-Vertragsstaaten und der Europäischen Kommission innerhalb von zehn Arbeitstagen in elektronischer Form zur Verfügung (§ 6 Absatz 3). Für die Richtigkeit der Angaben auf Etiketten und Datenblättern ist der Lieferant verantwortlich; seine Zustimmung zur Veröffentlichung dieser Angaben gilt als erteilt (§ 3 Absatz 3 Satz 1).
